I was told by consulate staff that the PIO card should be endorsed with the new passport # when you renew your foreign passport. I guess if you are traveling with both the old and new passport it should be ok, since they can verify right there. It is also a hassle endorsing the PIO card everytime you renew your passport. If you try to find out from the embassy/consulate ( that itself is a hassle), they will probably try to sell you for an endorsement. I do not know about the fees. I will be surprised if they didn't have one for endorsement.

My company's lawyer was supposed to revoke H1 of say (name changed) Venkatesh Natarajan and they by mistake revoked mine because of similarity of name(Vedant Narayanan). This happened in July and got approved in August (see below for details). The day my company got to know a wrong employee's H1 was revoked they filed for reinstatement.
Here are the chronological events
Date on which my H1 revocation notice was sent to USCIS: 7/28/2010
Date on which USCIS agreed to revoke my H1: USCIS says they got our letter of revocation on 8/15/2010, but their letter was dated 9/27/2010
Date when my employer was informed by lawyer's office about revocation: 10/24/2010
Date when my company filed for reinstatement of my H1, with pre-paid FedEx packet for USCIS to use with a reply: 10/25/2010. The USCIS has not responded to this letter.
Currently the action being taken is that they are in a process to file a new H1B as a backup, if USCIS doesn't reply to the letter or if they say that revocation process can't be undone.
I read about this nunc-pro-tunc provision. Do you think my new premium H1B should be filed with the nunc-pro-tunc provision? So that my new H1 is backdated from the day it was revoked.

How should we tackle this situation. Is there any other options that we can try, any phone number we can call? Any way we can ask USCIS to undo the revocation? Any suggestions/pointers appreciated.

Hi, I know this question is being asked by many people. I am sorry, but still confused. My situation is:
EB3 - Labor filed - Aug, 2004 - BackLogged - Philadelphia - 45 day letter - Replied
EB2 - Labor filed - Nov, 2005, Approved, I-140 filed - Mar 2006 - Approved.
Can I continue using EB3, once Labor Approved anbd I-140 Approved, can I use that PD to my EB2? The job description is definately different on EB3 and EB2. Still can I use the EB3 PD on to EB2?

SSN is not really a requirement to start to work. So the answer to your question is NO, she dont need SSN to work on EAD.
But in a practical scenario she need an SSN to work (see below reasons).
SSN is required to pay/withhold taxes and probably for pre-employment background checks and all. So it is very unlikely that an employer will hire somebody without an SSN (or at-least applied for SSN).

clarify21: If you would like to maintain the H1B status, for the part time job, you will have to ask your part time employer to do the new H1B; by having two H1Bs you can work for two employers the same time.
Can you do this?, am not so sure that you can have 2 H1B's and work for both. Don't you transfer your h1 to the new employer?
I am sure clarify can use the EAD for the both full and part time job.

total time in labor with news paper advt and all buffer is 6-8 months. I140 take another 2 weeks in premium processing. so in all 9months approx. that should give further extension on H1b.
Also even if previous I140 is revoked, you can have your PD attached to this new labor during I140 application.

Dear fellow IV members,
I was just referring to my first application for EAD filed by my lawyer (july filer)
For Q#12 - Date of last entry into the US - my lawyer had entered (05/10/2007) - the H1-B approval date in date of last entry in to US - is this because of the new I-94 attached to H1-B approval notice?
But the I-94 in the passport shows my actual physical entry into US after my last visit outside the country - 08/10/2006.
I have not traveled outside the country after renewing my H1-B.
Which date did you guys put - the actual date of physical entry or the I-94 start date after renewal of H1-B?

My wife has a valid H4 stamp in her passport till Jun2011 while my daughter has valid H4 but no stamp in her passport. Both are visiting Canada this week end.
My wife wants to re-enter on H4 as she does not have AP & my daughter wants to

I am sponsoring to My In-laws next month for visiting next month. I am preparing documents for them. My questions is... What are documents required from my wife side? she is not working.
What should I send from her?
A letter from her (& you) inviting her parents addressed to them and to the consulate.
If she isnt working, all the other sponsorship documents have to come from you.

My wife is currently on H4 and she is planning to apply for Residency here in the US on an exchange visa (J1). Let us suppose that she gets her status adjusted here in the US from H4 to J1 and then travels outside the US (say India). Then, she would have to get a J1 visa stamped on her passport. Considering that her spouse (that's me) would be on H1B, it would be rather difficult for her to prove that she would return to India. Do you think there is a greater chance of denial of J1 visa to her at the US consulate? If yes, how do you recommend we go about doing it? Your answer would be appreciated.

Depends on when you sent your H1 renewal application. If you expect the approval by Jan, then you can wait as you can get at least 3 yrs of DL (p.s. - some states give DL beyond the visa expiry date)
Otherwise, use EAD to get DL for 2 yrs.

Folks, I know this is a difficult time for many of us, especially Eb3 folks, but please don't loose your cool. Writing just on the forum will not get you anything. Contact your chapter leaders try to organize by actual calling each others. Learn what intiatives are already underway.
In the past there had been several discussion on filing lawsuit , doing this , doing that etc but not a single one of them even moved beyond this forum. If you are interseted I can give you those examples.
Now, let me share with you a story:
Belling the Cat
Long ago, the mice (folks on this forum) held a general council to consider what measures they could take to outwit their common enemy, the cat (read USCIS). Some said this, and some said that; but at last a young mouse got up and said he had a proposal to make, which he thought would meet the case.
"You will all agree," said he, "that our chief danger consists in the sly and treacherous manner in which the enemy approaches us. Now, if we could receive some signal of her approach, we could easily escape from her. I venture, therefore, to propose that a small bell be procured, and attached by a ribbon round the neck of the cat (read campaign/ lawsuits against USCIS) . By this means we should always know when she was about, and could easily retire while she was in the neighborhood."
This proposal met with general applause, until an old mouse got up and said, "That is all very well, but who is to bell the cat?"
The mice looked at one another and nobody spoke. Then the old mouse said, "It is easy to propose difficult remedies."

When i heard that little girls question (recorded version in NPR news this morning) and michelle's response of "well, i guess your mom should have 'proper' documents" sounds very interesting. Does she imply that she is not happy to face that question or does she say in a subtle manner that illegals should not be here ?
One more thing to note is that in Maryland, schools "do not" check legal status of children's parents during school admissions.but isn't that atleast an utility bill or rental contract is required as proof of residence? then in that case, how the systems are working here ?
On the other hand, one of my close friend ( 11th year in this country with H1B extension in pending) can not get a driver license despite the fact he is a tax payer, his status is absolutely legal, bought a home few years back, working for a real company, but just can not get his driver's license in Missouri.
What a shame?
In an extraordinary exchange at an event that is usually just a photo op, First Lady Michelle Obama fielded a question from a second grader that really reminds us of the fact that the millions of people in the US working without status today are real people with real families. While the antis choose to dehumanize these folks by portraying them as criminals and parasites, this little girl reminds us that we're talking about people who are faced with terrible choices in life - living in utter poverty in an unstable homeland or living in the shadows in a wealthy...
