Is it possible to file I-140 without joining the employer? Can one join the employer after the PERM and I-140 are approved? Any risks in this case?

u can file but u have to join the petition filing employer once u get GC or otherwise it will be fraud.

Democrats are on a dual strategy here. By backing farm labor they are trying to get the votes of the latinos. By not allowing this to wade in to other skilled jobs they are keeping their union members protected.

Democrats should be seen to be what they are. If you live in CA, you must e-mail Diane and ask her why she is discriminating against Indians, Chinese, Fillipinos etc.

By the time amendments are added the bill will be too heavy to pass in the senate and there will be no legislation passed! I am almost at the point of writing to my senators to vote against the bill!

I got married recently. Both my husband and I have similar priority dates as labour was filed separately for each of us by our respective companies. Is there any downside to adding each other to our applications and dual filing for greencard?

Is there any downside to having two applications in each name? Should we do this?

I think this thread is really good start. I think the inherent problem is not the fact that H1B is temporary and ppl want GC. Basic problem is ppl want the right to be able to work for who they want and they want the same for their spouses. This can be addressed by H1B reform also. But I think it will be an uphill battle because most businesses get captive employees by way of H1B visa and would be the real losers in case of a reform.

I am planning to file Labor in EB2. My Attorney sent job requirement which needs Master's + 1 year experience. But my current salary is almost 20k less than prevailing wage (level 4) for senior software engineer. But currently my salary equivalent to wage level 2.

I think i may get query at i140 , But Lawyer suggested Employer would need to be able to demonstrate their ability to pay the difference between actual salary and the prevailing wage at the time of the I-140 filing .

I am unable to get clear picture on wage levels. If i mention Level 2 , will this qualify for EB2?

Any suggestions on this.

Well, the 109th congress already passed part-I of the whole process: changing the US laws to allow special exception for India.

Once the President signs this, they have to negotiate the so called "123 agreement" that is a bilateral *binding* agreement between US and India. It will again have to be approved by congress.

I don't think anyone here knows how long will it take for the "123 agreement" to be concluded and presented to congress for approval. But once it does, expect desi resources on capitol hill to be again busy with it as their top priority. And that would shut us out for the period this stuff is pending in congress.

So what I am saying is that the window between now and when the "123 agreement" shows up in congress for approval is important and we should not miss it. At the very least we should be aware that this is coming and plan accordingly.

Child Protection Act is based on I-140 timing. If by the time of applying for I-140 your son got 21 then no-chance, it's not applicable. If not then some calculation is needed.
When did they apply for I-140. How old was your son at that time? When was it approved?

you dont have to withdraw 485 for dependents as it will automatically expire. In some rare cases USCIS may allow applicants who have stayed out of US beyond AP expiry date to reinstate AOS application but that is at the discretion of the officer. it could be humanitarian grounds.

if you can get 2 yr multiple entry AP, that could probably reduce your renewal frequency.

Hi all IV gurus,

My wife and I filed our I-485, EAD and AP on July 12th and the package arrived in NSC on July 13th. We have received all receipts and finished our FP about 10 days ago. I checked the online status and there are NO LUDs on any of our applications. All of them still show the ND of August 15th. I am EB3 ROW with PD Jan07. My I-140 is still pending at NSC.

My wife is currently on H-4 and she would like to work. Is she able to apply for a temporary EAD on October 15th, since it will already be 90 days since RD? If yes, how do we go about doing that?

Your experience and advice are very much appreciated!

I have few question regd H4 visa.

1. how H4 visa holder can study using education loan from india? if they get money through bank-to-bank transfer for education, they have to pay taxes right?

2. also now I know F1 students get their SEVIS number and this number helps DHS to track the students study programs/activities/money in US. This SEVIS number is given to F1 students by DHS.

so if H4 get this (education loan) money through bank-to-bank transfer, whether it will create a problem for H4 because they brought money from india without SEVIS number?

Please let me know.
