I was on H1B, recently got laid off (last week of February, 2009) --Since my wife is on H1B also, I changed my status to H4, which got approved a week back (3rd wk of April, 2009)...Now I've gotten to a point where I will soon be getting an offer from a company..
Can I start working, once they file for H4 to H1B transfer? or Does it have to be approved in order for me to start working?

I actually went to my appoitnment this morning at my local uscis office, the lady was nice. but i was told that the hospital letter need to state what are my granma's sickness instead just sayong terminally ill. and she had me to go back with a new letter tomorrow, and if her supervisor approves it, I will get it right away.

I know it is a loss in priority date. But my point is: "does fighting with the lawyer, give him his time back?" In fact by that he is loosing his valuable time and energy further.
If there is "ANY" method to get his "LC" approved with the same priority date, I totally agree he should do that.
That is what I mean by "focus on your goal". If your goal is to fight with lawyer for a cause, just do it. You will at least feel happy that you did the right thing, whatever you felt right.
Also "you pay the lawyer to represent you and to do things for you". The "payment" is not for a 100% error-free service. It is always back on your shoulder to make sure the lawyer is doing the right thing. Many of you may not agree, but that is my view. It is just a service. Not an "error-free-guaranteed" service.

So the dates are moving ahead but what does this really imply ? With priority dates retrogessed to around 2000 and no visa numbers availble for EB3. Who is getting the GC. Is it only the Eb2 with PD around 2000 or any one else.

While there is some debate reg. what these dates refer to, the USCIS, on this page, clearly states that these are receipt dates (RD) on your receipt notice (for I-485 or whichever document you are checking processing times for).
[The processing dates shown below represent the receipt dates of petitions and applications currently being processed by the USCIS Service Center.]
Based on your EB-category and country of chargeability, if your PD is current AND your RD is earlier than the one indicated in this "Processing Times" page, then you should already have your GC - if you don't you MUST contact NSC.

Google search on Portability with I-140 in "Approvable" condition.
That is your solution, incase you have to change employers before I-140 and 485 are approved, with 180 days passed.

I think if you have 2 years left, you will get H1 transfer and the new H1 will have 2 years. After those 2 years, you will get another 3 years if your 140 is not revoked by your previous employer.

What I intend to say is "No one will help you" - YOU HAVE TO HELP YOURSELF
Chandu ..your posts are always sensible and you describe the problems correctly ..I had a quick question though ..how do you help yourself / ourself (apart from donations to IV, volunteering etc) ?
do we meet congress man ,, if yes, then everyone should do it simultaneously .. but again they will talk about jobs for americans !!
and hence I say ..we need to meet realtors in large numbers ..show interest and make them salivate for your business and then back out of the deal !!!

My H1B is valid till 2011. I came through “A” company and this is my second employer (“B”). After I joined “B” company, I never went out of USA. “B” Company’s name is not reflected in my H1B visa (in passport). Only I have the copy of I129 with “B” company’s name. Now, I am no more with “B” company.
1. What is the process of re-enter to USA ? I mean, what type of documents I need to show to Immigration Dept ?
3. My families also need to re-enter to USA at the same time ?

The employer would offer you (and only you) one way ticket to the final destination to your country. You have to bear the cost of your family members.

2. Join IVjobhunters group and check the PERM employers who have earlier hired H1B and apply to them. There are more than hundreds of employers in each field. In IT its more than thousands (around 60 thousand at least). If you need help in this area PM me.
