:) there are too many variables to this equation. even ajmeri will hang up on you if you ask him when somebodys EB3 will be current.
all joking aside, it will be a nightmare for EB3 as well as EB2 unless there is some kind of reform. EB3 with a PD of 2004+ for india, china, mexico and some more other countires could easily take 10 years. I am an optimist and i still I think we will the dreaded 'U' pretty soon. There is a urgent need to educate people about this and get something passed, EB is totally broken.

I have a few questions and much thanks for those who answer.
1. I have had a H1-B in 2002, but I did not get a stamping. I quit my job and went back to school. I'm out of school now, do not have an OPT (second masters) and worried about the cap.
I heard that people who have held H1-B's in the past do not come under the cap. Is this true?
2. A company is interested in hiring me but only in the muiddle of August (they want to conduct a few more interviews). The cap would most likely be reached by then. Do I have any other options?

No, only contiguous H1-B renewals(after 3 years or yearly extensions after 6 years) are exempted from the cap. If you go back to school and apply for a fresh H1, then it is very much counted against the cap. Apart from falling back to H4 or F2(if you are married and your spouse is on H1/F1), i dont see too many options if you cannot get one of the masters quota H1. BTW, if you dont have an OPT and are out of school, then how are you still here ?

I have a hard time to adjust my photo to designated spec. I shrunked to 62kb but they did not take it and if I make it lesser, it won't be 320 x 240 pixels but less. I use regular digital camera. anybody help me how to do?

Sorry to hear about your problem with the D70...
I don't know anything in detail about D70, as I'm a Canon man myself...
But some general thoughts and ideas:
1. From the behaviour, I would think that something has gone wrong with either the RAM or the ROM(flash) in the camera. This would cause a similar thing to a "Blue Screen of Death" that you get on a PC sometimes when something has gone wrong somewher. In a machine like a digital camera, the most sensible thing to do to try to recover is to "reboot", or put another way, reset the camera.
2. It is possible that it's just a "transient problem". Have you tried removing the battery for a longer period of time (at least half an hour), and also, if there is a small battery for keeping the time when changing batteries etc. (don't know if the D70 has one, the Canon ones does), you may want to remove that too to be sure that the camera is "properly powered off". This may of course reset some of your personal settings and definitely should reset the time/date in the camera, but I'm sure you can live with that.
3. It may be possible to "reprogram the flash" using the standard procedure for updating the firmware in the camera. *** I would only do this as a "last ditch attempt" ***. I don't know how this is done, but I'm pretty sure there is a way to load a new set of firmware onto the camera some way. But if it's the RAM that is broken, this may cause the firmware update to fail and that may cause even worse scenario than what you've got, so I would only do that if you think that "Things can't get much worse". This is akin to a PC being re-installed from scratch. Like the PC case, it doesn't actually help much if the actual cause of the problem isn't the software/firmware itself. Don't blame ME if this doesn't help, and it makes things worse!
I hope some of this is of help, if nothing else, to understand what the problem is.
If it really is the RAM that is busted, it's probably going to be fairly expensive, as I don't expect the repairer will replace the individual parts, but rather just swap the whole PCB, which means "all the guts of the camera".
If, on the other hand, it's just the flash that's gone crazy, then it's most likely just a question of "factory programming it", which would be a relatively trivial operation, and shouldn't cost much to fix.

Thanks all for the advise/comments. Mixed opinion. I was hearing that, because of Indian Rs gaining stongly aganist US$, outsourcing to India is not cheap anymore. I also informed that hiring fulltime/permanent employee in US is cheaper than outsourcing. I do not know howmuch true it is.
IS all QA jobs are shorterm in nature? As I have already a GC, is it easy to get fulltime (longterm)/permanent job in QA?

Who told you they process around 4500 application per day at NSC, or you just figured it out all by yourself? I'd love to konw your source, or how you did it.
i guess you're right. in my case, receipt date and online case date for I-140/change of status were the same.
anyway, Nebraska process around 4500 application per day--that includes all kinds of form I-765, I-131, I-140, I-485, etc. assuming that 25% of those are are I-485 then they process 1000-1125 I-485/day. again, assuming 40,000 I-485 are still to be encoded then the average waiting time is 35-40 days. whew, i expect mine first week of september.

The maximum duration of a J-1 is 7 years but the visa is issued 1 year at a time (royal pain). Therefore there is nothing such as a transfer. When residency is over, if you get a fellowship the program files with ECFMG the necessary papers to prove that it's an accredited program etc It is ECFMG that sponsors you not your program/hospital. Each year the program informs ECFMG on your progress and based on that a new sponsorship for another year is granted.
After my first fellowship i was board certified. In order to specialize further I (and my new department) had to convince ECFMG that there was some merit in the whole proposal. anyway long story, they did sponsor me and I did another 2 years thus completing the entire 7 year period.
As for GC, my employer just started the process and insisted on choosing an expensive corporate lawyer they have worked with before. She is in no hurry and I don't know when I will even have a priority date let alone a GC. This is after 11 years here. such fun....

In india we celebrate the bharat pravasi diwas (NRI Day) and PM is in attendance. Remittance to India is a big boost to the economy.
PM should give a hint to Obama on EB issues but I don't expect PM to help me get my GC. Bharat Pravasi diwas is a good way to initiate this dialogue within the NRI community.
